Before You Rely on a Mugshot, Understand What the Record Actually Shows
A mugshot or jail booking entry documents an arrest or detention-stage event. It does not by itself prove guilt, establish a conviction, show the final charge, or tell you how the court case ended.

USA-Mugshots.com is an independent informational website. It does not operate sheriff offices, jails, courts, state corrections systems or federal inmate databases, and readers should verify consequential information through the government agency or court responsible for the underlying record.
Mugshot Disclaimer: Arrest and Booking Records Are Not Convictions
The most important distinction on any mugshot page is the difference between an accusation-stage record and a final court result.
A booking photograph is normally created during jail intake or another custodial process. A booking record may also contain a name, arrest date, booking number, holding agency, initial charge information, bond information or current custody status where the responsible agency publishes those fields.
None of those items, standing alone, establishes that the person was convicted of the alleged offense. Federal court jury instructions reflect the broader criminal-law principle that an accused person is presumed innocent unless guilt is proven according to the applicable legal standard.
Arrest
A law-enforcement action or custody event. It may begin a criminal process but is not the final adjudication.
Booking
The intake stage can generate a mugshot, booking number, initial charge information and jail status.
Disposition
The later result of the criminal matter, such as whether charges were pursued and how the case was resolved.
What a Mugshot or Jail Booking Does Not Establish
A mugshot does not establish
- Guilt
- A conviction
- The final filed charge
- The final court outcome
- The current custody status unless the source is current
- A person’s character, honesty or dangerousness
- That two people with the same name are the same individual
A booking record may help establish
- That an arrest or detention intake was recorded
- An arrest or booking date
- A booking or inmate identifier
- The arresting or holding agency
- Initial allegations shown by the booking system
- Bond or custody information where published
- A booking photograph where the agency releases one
Booking Records, Jail Records, Court Cases and Criminal History Are Different
A common source of misinformation is treating several different government records as though they are interchangeable.
| Record | Usually maintained by | Useful for | Main limitation |
|---|---|---|---|
| Booking record | Jail, sheriff, corrections or booking agency | Arrest date, intake details, initial charges, mugshot where released | Does not show the complete later case result |
| Current inmate record | County jail, city corrections or state/federal corrections | Present custody or facility information | A released or transferred person may disappear from a current roster |
| Incident or arrest report | Investigating or arresting law-enforcement agency | Agency documentation concerning the reported incident or arrest | Not necessarily the final charging or disposition record |
| Court case | Court or clerk | Filed charges, hearings, motions and available disposition information | Availability and online access vary by jurisdiction |
| Criminal-history record | Authorized state or federal repository | Broader arrest/disposition history within the system’s legal scope | Access, permitted uses and completeness vary by law and repository |
How to Verify a Mugshot, Arrest or Booking Before Relying on It
Identify the correct jurisdiction
Determine the state, county or city where the arrest occurred. A broad name search can combine unrelated people and different jurisdictions.
Find the responsible official custody source
Look for the sheriff, county jail, corrections department or municipal detention authority that actually maintains the booking or inmate record.
Match more than the name
Compare available identifiers such as middle name, suffix, age, date of birth where lawfully published, booking date, agency, booking number and jurisdiction.
Separate the initial charge from the court charge
The allegation displayed at booking may not remain unchanged. Use the court system to verify what was actually filed and what later happened.
Check the disposition
If you need to know whether the person was convicted, acquitted, had charges dismissed or received another outcome, use the appropriate court or authorized criminal-history source.
Recheck time-sensitive facts
Custody status, bond, release dates, pending charges and court schedules can change. Reopen the official source when the information affects an important decision.
Current Inmate Listings and Historical Arrest Records Serve Different Purposes
A person who was booked yesterday may appear on an active jail roster today and disappear after release or transfer. That change does not necessarily erase the underlying arrest or court record.
Similarly, an old mugshot copied to a third-party page does not prove that the person remains incarcerated, that the charge is still pending, or that the case ended in conviction.
County and city custody
Use the sheriff, jail or local corrections department responsible for the detention system.
Federal custody
The Federal Bureau of Prisons provides an Inmate Locator for federal inmates incarcerated from 1982 to the present. BOP also warns that release information can change and that someone outside BOP custody may still be in another justice system or under supervision.
Do Not Identify Someone From a Name or Mugshot Alone
Common names, similar appearances, reused photographs and copied third-party pages can produce serious mistakes. Before connecting an arrest record with a specific person, compare multiple official identifiers whenever they are lawfully available.
- Full name and middle name
- Suffix such as Jr., Sr., II or III
- Booking or arrest date
- Jurisdiction
- Arresting or holding agency
- Booking or inmate number
- Case number
- Age or date of birth where officially published and appropriate to use
Do Not Use This Site as an Employment, Housing, Credit or Insurance Background Report
USA-Mugshots.com’s published Privacy Policy describes the site as an independent informational resource rather than a consumer reporting agency or background-check service.
The Fair Credit Reporting Act regulates consumer reports used for specified purposes. FTC guidance explains that employment and tenant background reports can be subject to FCRA requirements, including accuracy and procedural obligations.
For that reason, information found on this site—or on an ordinary mugshot, jail or arrest page—should not be treated as a substitute for a legally compliant consumer-reporting process when making regulated decisions.
Employment
FTC guidance says employers using consumer reports for hiring and other employment decisions must follow FCRA procedures.
Housing
FTC guidance also explains FCRA protections and accuracy concerns in tenant background screening.
If a Mugshot Result Is Wrong, Outdated, Sealed or Exploitative
The correct remedy depends on where the problem exists. An inaccurate official record, an outdated search result, a copied third-party mugshot and a sealed or expunged case are not the same problem.
| Problem | Best starting point | Important distinction |
|---|---|---|
| Official record contains an error | Agency, court or repository that maintains the record | A third-party website generally cannot correct the government’s source record. |
| Case was sealed or expunged | Applicable court, attorney or jurisdiction-specific procedure | Sealing and expungement rules vary by state and case type. |
| Third-party page is outdated | Source website first; then applicable search-engine update/removal tools | Changing a search result does not necessarily delete the source webpage. |
| Website demands payment to remove personal content | Google exploitative-site removal process where eligibility requirements are met | Google can remove qualifying URLs from Search without erasing the original webpage. |
| Wrong person with same name | Publisher plus responsible official source | Document the mismatch with reliable identifiers rather than relying only on appearance. |

How to Use Arrest and Jail Information Responsibly
- Verify the correct person before sharing an arrest record.

- Check the court record for later case status.
- Do not assume an old mugshot reflects current custody.
- Respect sealed, expunged, restricted and nonpublic records.
- Do not use public-record information to harass, threaten, stalk, extort or impersonate another person.
- Do not treat a mugshot page as a legally compliant consumer report.
- Use the responsible official agency for time-sensitive or consequential information.
Mugshot Disclaimer FAQs
Does a mugshot mean someone was convicted?
No. A mugshot is generally created during the arrest or booking stage. A conviction is a later legal result and should be verified through the appropriate court or authorized criminal-history record.
Does an arrest record prove someone committed a crime?
No. An arrest record documents an arrest or detention event. It does not by itself establish guilt. The criminal process can later result in dismissal, acquittal, conviction, a plea or another disposition.
Is a booking charge always the final charge?
No. The charge shown at booking can differ from what prosecutors later file or what the court ultimately resolves. Check the court record when the later charge or disposition matters.
Why can someone disappear from a jail search?
Current inmate databases can change after release, transfer or another custody event. A missing current-inmate result does not automatically mean that an earlier booking never happened.
How do I know a mugshot belongs to the right person?
Compare multiple official identifiers such as full name, middle name, suffix, booking date, jurisdiction, agency, booking number and court case information. Do not rely only on appearance or a common name.
Can I use a mugshot page for an employment background check?
USA-Mugshots.com is not a consumer-reporting service. Employment background reports obtained from consumer reporting companies can be subject to the Fair Credit Reporting Act and related procedures. Use an appropriate legally compliant process rather than an ordinary mugshot page.
Can I use mugshot information to screen a tenant?
Do not treat this site as a tenant-screening report. FTC guidance explains that tenant background reports can be regulated by the Fair Credit Reporting Act and can involve accuracy, disclosure and dispute rights.
Where should I check the final outcome of an arrest?
Use the court or clerk responsible for the criminal case. Depending on the jurisdiction, that may be a municipal, county, district, circuit, superior or state court system.
Can Google remove a mugshot result?
Google provides several personal-content removal processes. One applies to qualifying exploitative sites that require payment for removal. Removal from Google Search does not necessarily remove the underlying webpage from the internet.
Is USA-Mugshots.com a government website?
No. USA-Mugshots.com is an independent informational website. It is not a sheriff’s office, police department, jail, court, corrections department or other government agency.
